Jared W. Hays
Biography

Jared Hays represents clients in complex commercial real estate transactions throughout the United States and internationally. He has extensive experience with transactions involving data center and colocation properties, including purchases, sales, leases, colocation licenses, colocation services and carrier agreements.


Notable client matters for Jared include: representation of investors in the purchase/leaseback of enterprise data center facilities, including several multistate portfolios; representation of a cloud and colocation services company as a tenant/licensee in data centers globally; and representation of a real estate investment trust in connection with its leasing activities throughout the U.S., Europe and the Asia/Pacific region.

Representative Matters
  • Representation of a NYSE-traded REIT in connection with its leasing activities throughout the U.S., Europe, Australia and Asia/Pacific, representing billions of dollars of total contract value (“TCV”)
  • Representation of purchasers in the purchase/leaseback of enterprise data center facilities and portfolios in the U.S. and in England, including:
    • A multistate portfolio for $160 million;
    • A multistate portfolio for $45 million;
    • A midwest data center for $24 million; and
    • A northeast data center for $7.5 million.
  • Representation of a cloud and colocation services company as a tenant/licensee in multiple data centers in the U.S., England, Germany, Australia and Hong Kong
  • Representation of data center developers in turn-key leasing agreements, including:
    • A northern Virginia lease with a TCV of $270 million;
    • A northern California lease with a TCV of $105 million; and
    • A northern Virginia lease with a TCV of $25 million
  • Representation of owners in master leases, under which facility operations and existing lease and license agreements are assigned to the master tenant, including:
    • A NNN lease with a TCV of $60 million;
    • A NNN lease with a TCV of $28 million;
    • A NNN lease with a TCV of $9 million; and
    • A NNN lease with a TCV of $7.5 million
  • Advising both developers and occupants on build-to-suit construction and leasing transactions, including:
    • A tenant in a build-to-suit lease in central Texas with a TCV of $70 million
  • Representation of developers in the negotiation of design and construction contracts on AIA and other forms
  • Representation of owners for telecommunications access contracts with carriers
  • Representation of owners for data center facilities management agreements
  • Representation of developers and investors in the acquisition, disposition, financing and leasing of office, retail and industrial properties throughout the U.S.
  • Appointment as trustee for non-judicial foreclosures throughout Texas
